Jail for duo who caned two students in Kelantan

PASIR MAS, April 29 - Two men were on Tuesday sentenced to jail by the Magistrate's Court here after they pleaded guilty to caning two students of Sekolah Menengah Agama Khairiah on March 10.

Wan Rosly Wan Husin, 33, from Kampung Lubok Kawah, Rantau Panjang and Md Azman Ibrahim, 23, from Banggol Setol, pleaded guilty to voluntarily causing hurt to Mohd Asrul Ahmad, 17, at 7 pm in a classroom of the school. The students were each caned 25 times.

Both of them also admitted committing the same offence, punishable under Section 323 of the Penal Code, on Suria Ismail, 16, at the same time and place.

Magistrate Ahmad Bazli Bahruddin sentenced Wan Rosly to 14 days' jail on each count and ordered the sentence to run consecutively.

Md Azman was sentenced to seven days' jail for the first offence and fined RM800 for the second or one month's jail, in default.

Both of them claimed trial when they were produced in the same court on March 18.

Deputy Public Prosecutor Azmi Ariffin, in presenting the facts of the case, said Wan Rosly had gone to Mohd Asrul's house on that day and brought him to the school to be caned.

Md Azman had assisted by holding Mohd Asrul as Wan Rosly whipped the boy 25 times for allegedly committing an offence, which was later proven to be baseless. A medical report showed that Mohd Asrul had 18 wounds as the result of the caning.

Azmi said Wan Rosly then took similar action against Suria and she had three wounds on her thigh.

Both students were caned before a group of other students in the school, he said.

In mitigation, counsel Muhammad Hasif Hasan urged the court for a lenient sentence as both the accused had admitted to committing the offence and had shown repentance.

He said both accused were also students, one studying at a pondok school in a neighbouring country, while the other in a college in Terengganu and would be sitting for his examination in the middle of next month.

Azmi urged the court to impose a stiffer sentence as a deterrent to others not to take the law into their own hands and also consider the fact that both accused were not staff of the school.

The court should also consider the mental sufferings and shame of the two victims and their respective parents, he said.

"The best sentence will be sending them to jail," he said.
